Lions Gate Internet Policy Statement
1.0 Lions Gate Internet Accounts
1.1 Lions Gate Internet accounts are to be used only by the person in whose name the account was created. Corporate accounts are to be used only by members of the group or organization named by the account.
1.2 All accounts are granted subject to compliance with this policy statement. Failure to comply with these guidelines may result in account termination.
1.3 The management of Lions Gate Internet reserves the right to cancel accounts without giving notice to the account holder or any authorized users of the account. Any positive account balance will be returned according to the guidelines in paragraph 1.4. Accounts that have been closed due to non-payment shall only be reopened when the outstanding balance has been paid, along with a reconnection fee of $25.00.
1.4 In the event that an account is cancelled by Lions Gate or it's agents, a full or pro-rated refund for any unused portion will be returned to the account owner by cheque. All registration and one-time setup fees are non-refundable. Refunds issued by Lions Gate Internet will be sent by company cheque only, and shall be delivered to the client by regular mail within 8 weeks.
1.5 All service/access fees are fully earned 5 business days after service begins, and Lions Gate Internet shall not issue refunds for services that are cancelled or downgraded by the account owner more than 5 days after being activated. Lions Gate Internet shall not issue a refund for accounts that are pre-paid more than one month, but will offer a comparable credit in service for any balance owing in the event of a cancellation or downgrade in service level. Minimum cancellation notice is 2 weeks.
1.6 Conversion between membership types will be performed on request for a fee (or credit) equivalent to the difference in value between the two membership types. A service charge also applies.
1.7 Accounts may be deleted when they have been expired for six (6) months or longer. All records are destroyed at this time and no refunds are possible on deleted
accounts.
1.8 All payments must be verified prior to crediting accounts. Accepted payment methods are cash, cheque, money order, Visa or Mastercard. Payments should be made to:

1.9 Any bank charges incurred by Lions Gate Internet because of NSF cheques or similar circumstances will be charged back to the member's
account, along with a service charge of $25.00.
1.10 Lions Gate Internet memberships confer upon their owners a set of privileges that vary according to membership type. These privileges are subject to change without
notice.
1.11 An Lions Gate Internet account holder is responsible for ensuring that their account's billing data is current and accurate. Providing false data on a signup form, contract, or
other application, including fraudulent use of credit card numbers is grounds for immediate account termination.
1.12 Lions Gate Internet attempts to provide an environment free from Unsolicited Commercial Email (UCE). For that purpose Lions Gate Internet reserves the right to block mail from
third parties and to filter UCE from Usenet newsgroups. Regardless, it is impossible to guarantee that a Lions Gate Internet member will never encounter UCE and members are
strongly encouraged to protect the privacy of their email accounts
2.0 General Conduct and Acceptable Use Policy
2.1 The types of conduct described in paragraphs 2.2 through 2.5 are grounds for immediate suspension of service pending investigation by Lions Gate Internet or it's agents,
and may result in termination of the account or accounts deemed to have been involved with such conduct.
2.2 General Conduct
The following conduct shall not be permitted by Lions Gate:
(a) Continued harassment of other individuals on Lions Gate Internet or the Internet after being asked to cease and desist.
(b) Impersonating another user or otherwise falsifying one's identity in email, Usenet postings, on Internet Relay Chat (IRC), or with any other service. This does not
preclude the use of nicknames in IRC, the use of anonymous email services, or postings to those Lions Gate Internet or Usenet newsgroups that permit pseudonyms.
(c) Privacy violations: Attempts, whether successful or not, to gain access to Lions Gate Internet or any other system, or users' private data without express consent of the user.
(d) Use of unauthorized IRC bots or clonebots on Lions Gate Internet, whether on IRC servers controlled by Lions Gate Internet or by other parties. An IRC bot is a program that runs
and remains connected to an IRC server 24 hours a day, automatically performing certain actions.
(f) Using Lions Gate Internet or Lions Gate Internet services to encourage, facilitate, or engage in illegal activities.
2.3 Attempts to circumvent Security of Computer Systems and Networks
The following conduct shall not be permitted by Lions Gate:
(a) Lions Gate Internet account holders may not attempt to circumvent security or authentication systems on any host, network hardware, or user accounts. This includes, but
is not limited to, the account holder logging into a server or account the account holder is not expressly authorized to access, or probing network security.
(b) Lions Gate Internet account holders shall not interfere with the operation of Lions Gate Internet systems or networks, or engage in activities which adversely affect the ability of
other users or systems to use Lions Gate Internet services or the Internet, including, but not limited to:
1. Denial of service attacks including, but not limited to, flooding of networks, attempts to overload a service, attempts to cause system crashes.
2. Any use of this or any other system as a staging ground to interfere with the operation of other systems.
2.4 Lions Gate Internet and Usenet newsgroups
The following conduct shall not be permitted by Lions Gate:
(a) Lions Gate Internet users shall not post a single article or substantially similar articles to an excessive number of newsgroups, or cross-post to an excessive number of
newsgroups.
(b) Lions Gate Internet users shall not continuously post articles which are off-topic, as defined by the newsgroup charter or post articles which provoke complaints from the
regular readers of the newsgroup for being off-topic.
(c) Lions Gate Internet shall not post binary or encoded binary files to newsgroups not specifically designated for that purpose.
(d) Lions Gate Internet users shall not engage in any of (a), (b), or (c) from a provider other than Lions Gate Internet while using an account on Lions Gate Internet as a mail drop for
responses, or to draw attention to a service hosted within Lions Gate Internet networks.
In addition, Lions Gate Internet reserves the right, where feasible, to implement technical mechanisms which block the activities described in (a), (b), (c), and (d).
2.5 Email
The following conduct shall not be permitted by Lions Gate:
(a) Sending unsolicited bulk mail.
(b) Mail bombing, defined as sending or causing to be sent large volumes of unsolicited email to a single or multiple entities.
(c) Sending email to any person or process that does not wish to receive it. If a recipient asks to stop receiving email from a Lions Gate Internet member then that Lions Gate Internet member must not send further email to the email account in question.
(d) Engaging in either (a), (b), or (c) from a provider other than Lions Gate Internet and using an account on Lions Gate Internet as a mail drop for responses, or to draw attention to a
service hosted within Lions Gate Internet networks.
(e) Subscribing a third party to a mailing list or other mail service without their consent.
In addition, Lions Gate Internet reserves the right, where feasible, to implement technical mechanisms which block the activities described in (a), (b), (c), (d) and (e).
3.0 Publicly Posted Information
3.1 All files, messages, and other information made available on Lions Gate Internet by a Lions Gate Internet member are the sole responsibility of that member. All files, messages,
and other information posted via automated methods such as Usenet by non-members are the responsibility of those people.
3.2 Section 3.1 notwithstanding, information made available on Lions Gate Internet may not slander or persecute individuals or identifiable groups of people. Such information may be removed at the discretion of Lions Gate Internet Management.
3.3 Public messages posted to Lions Gate Internet may not contain crude or offensive language except where such language is a necessary part of an artistic expression. Offensive messages may be removed at the discretion of Lions Gate Internet Management.
3.4 Commercial messages may not be posted in a noncommercial Lions Gate Internet newsgroup without prior approval from Lions Gate Internet management.
3.5 Lions Gate Internet Management reserves the right to remove any information made available on Lions Gate Internet systems at any time.
4.0 Lions Gate Internet File Libraries
4.1 All files are provided on an "as is" basis with no warrantees expressed or implied. It is the responsibility of the user to select and download files, to determine the
suitability of those files for whatever purpose, and to employ or attempt to employ them for that purpose.
4.2 Files uploaded to this system must be public domain or freely distributable. Lions Gate Internet is opposed to software piracy and any use of Lions Gate Internet facilities for software piracy will be reported to the appropriate authorities when brought to our attention.
4.3 Lions Gate Internet shall select librarians whose duty it is to download newly submitted files and attempt to verify that they are freely distributable and free of viruses, and shall compensate the librarians for that effort.
4.4 Lions Gate Internet members are advised to take precautions of their own with regard to viruses. In particular, all executable files should be scanned for viruses immediately after downloading and before first being executed.
4.5 Lions Gate Internet reserves the right to remove or refuse any file uploaded to this system without notice and for any reason.
5.0 Censorship
5.1 Lions Gate Internet exists to facilitate communication and we feel that censorship compromises that goal; hence Lions Gate Internet will not censor files or messages flowing through our facilities on the basis of morality, taste, desirability, or any other basis except legality.
5.2 Lions Gate Internet shall attempt not to distribute any file or message if doing so would be contrary to the laws of Canada or the laws of the province of British Columbia, and Lions Gate Internet members are reminded that they are responsible for information they make available and are bound by those same laws.
5.3 Lions Gate Internet reserves the right to remove from the system messages or e-mail deemed by our software to be unsolicited advertising. Messages and e-mail may be removed for technical reasons, in the event that the file in question is deemed to pose a risk to the stable operation of the system.
6.0 Policy Statement
6.1 This policy statement is subject to change without notice. Significant changes will be announced in an appropriate manner. A current policy statement is always available.
